Solid Legal Case Moves through Appeal Process

(Phoenix, AZ) — Yesterday’s ruling in AZRTL v. Fontes/Arizonans for Abortion Access, the judge agreed with the Committee (the abortion industry) that the petition description was “legally sufficient.”

As the Committee noted in oral arguments on Friday, August 2nd, only two previous cases have bumped a petition from the ballot due to misleading descriptions. As noted in the pleadings, the description is simply a near verbatim copy of the Act itself. The court did not agree with our argument that the language was confusing, misleading, and failed to provide the principal provisions (and thrust) of the Act.

In Superior Court on August 2nd, AAA attorney stated that this initiative, if passed, will establish a fundamental right to abortion in the Arizona constitution ‘both before and after fetal viability.' Arizona Right to Life received many texts and calls from people after this, who signed this petition that wanted to retract their signatures as they were confused about the language and the definition of fetal viability. Abortion after fetal viability is abortion up to birth. Had AAA clearly stated that on the petition, the majority of signers would not have agreed to sign.

Unfortunately, the judge did not agree. We will be appealing this ruling and continue to work educating the public as to what this initiative really says and does.
