Arizona Abortion Access Misleads the Public Again

08/14/2024  |  Press Releases

Once again, Arizona for Abortion Access (AAA) is misleading Arizonans by publicizing that their Initiative is on the ballot. The truth is, Arizona Right to Life has a pending lawsuit regarding the ballot language. As such, the Initiative cannot be on the ballot until the lawsuit is decided by the Arizona Supreme Court.

Their faulty abortion distortion petition is misleading. Despite AAA’s public claims that the initiative only protects the right to an abortion through viability, Austin Yost, the AAA attorney, admitted in Superior Court that “the initiative would establish a fundamental right to abortion in the Arizona Constitution and would prevent the State from denying, restricting, or interfering with this fundamental right in specific circumstances both before and after fetal viability.”

Abortion is legal in Arizona up to 15 weeks (and later for medical emergencies) and the Abortion Access Amendment will allow abortion up to birth. And, the “specific circumstances" that allow abortions after viability are dependent upon the “good faith judgment” of a “health care professional.” Please note that “good faith judgment” and “health care professional” are not defined. The language is meant to be vague in order to allow for the broadest expansion in the interpretation.

Arizona Right to Life will continue to speak out and educate the people of Arizona on the true intent of this issue: ABORTION UP TO THE MOMENT OF BIRTH, loss of health and safety standards for women and removal of parental consent for minors seeking an abortion.

Correction notes: A previous version of this press release incorrectly quoted Mr. Yost as saying that the Initiative has “unrestricted abortion up to and after fetal viability” when he actually said that the “initiative would establish a fundamental right to abortion in the Arizona Constitution and it would prevent the State from denying, restricting, or interfering with this fundamental right in specific circumstances both before and after fetal viability.”
