Arizona Supreme Court Rules Prop 139 Language Is Sufficient
08/21/2024 | Press Releases(Phoenix, AZ) - Today, the Arizona Supreme Court decided to allow the 190-word description provided by Arizona Abortion Access. Arizona Right to Life maintains the description had failed to disclose the radical breadth of the proposed Amendment.
Jen Wright, attorney for Arizona Right to Life stated to the court, “...the proposed amendment as worded, will result in the complete invalidation of AZ abortion regulations and leave late- term abortions solely to the “good faith” discretion of individuals financially benefitting from performing the abortion.” It was also argued that voters were not clear on the vague language and its meaning. Specifically, Prop 139 would allow by its language, that a viability standard subject to “good faith judgement” is far different from the objective standard under current Arizona law; namely, “standard medical practices and techniques used in the medical community” would be rejected. This was done with intention to mislead the people of Arizona and to further the profit the Abortion Industry under the guise of Abortion Access and Reproductive Rights.
Congressman Biggs and the Hon. Barbara Parker filed an Amicus Brief in support of the claims of Arizona Right to Life stating, “the language of the initiative is lacking clarity, so that voters won’t be aware that by voting in favor of it, they are effectively voting to elevate abortion above existing fundamental rights, which means that not even the courts will retain their power to apply traditional legal standards to abortion.”
Prop 139, now on the ballot, has had the highest fraudulent signature rate than any other Initiative in Arizona at almost 250,000 false signatures. Arizona Right to Life maintains that many of the paid circulators were misleading the public with their varied explanations of the Initiative and there were many incongruous statements about when abortion would be limited. Ashley Trussell, Chairperson for Arizona Right to Life concluded, “We are looking forward to working with our pro-life partners across the state to continue to inform voters about this ambiguous language which allows for extreme, painful dismemberment abortion up to birth.”
