Arizona Right to Life Moves Forward with Petition Challenge

The complaint against the AZ Abortion Access Act was amended and a Motion for Summary Judgment was filed.

(Phoenix, AZ) – Arizona Right to Life (AZRTL) amended their challenge today, focusing on its strongest argument against Planned Parenthood’s Arizona Abortion Access Act; namely that the petition description and the Act itself is confusing and misleading and that if people had understood the sheer breadth of the Act, they wouldn't have signed the petition.

“We remain optimistic that we will prevail and that this faulty petition will not be on the November ballot,” says AZRTL Board Member Jill Norgaard. “Our volunteers have been instrumental in their discoveries and support. Our efforts will continue as we argue why the 200-word description is legally insufficient.”

Today, Arizona Right to Life filed an amended complaint with the court arguing the Petition and the Abortion Access Act itself was confusing and misleading such that the Act should not be placed on the ballot. Oral arguments will be heard this Friday.

“Because the arguments in the motion are so strong, Arizona Right to Life dropped the second count, which would have required a massive amount of evidence to be prepared and presented for trial on August 12th,” says AZRTL Attorney Jennifer Wright.
